Village amends solicitation ordinance

At the Oct. 9 meeting, the Village of Whispering Pines Council approved an amendment to Chapter D of the Code of Ordinances pertaining to solicitation within the Village, announced the Village on its website.

The changes are:

Section 2. Going on Private Property Without Invitation:

(A) No person may go upon residential premises for the purpose of door-to-door sales or solicitations of any kind after sunset or 8:00 PM, whichever is earlier, or before 8:00 AM.

(B) No person shall go upon residential premises or attempt to reach the occupants of a residence by ringing a doorbell, knocking on a door, or otherwise attempting to gain the attention or presence of an occupant if there is posted any sort of notice to the effect of “no soliciting” or “no trespassing” or any other message that a reasonable person would understand to mean that the occupant does not want any uninvited persons to intrude on the peace and quiet of their residence.

(C) A violation of any provision of this Section shall be subject to the enforcement remedies set forth in Chapter J.

The approved amendment is consistent with recent court rulings regarding First Amendment rights, said the Village.
